These AI Terms apply to the artificial intelligence features provided through Instapaytient ("Instapaytient AI") and are incorporated into the Instapaytient Services Agreement.
By using Instapaytient AI, the Practice agrees to the following:
Instapaytient AI is designed to help patients ask questions, explore treatments and services, understand affordability and financing options, and take appropriate next steps with the Practice.
Instapaytient AI is a patient engagement technology and is not a healthcare provider.
Instapaytient AI is not intended to diagnose medical conditions, prescribe medications, recommend medical treatment, make clinical decisions, or replace the judgment of a licensed healthcare professional.
Patients should be directed to qualified healthcare professionals when clinical evaluation, diagnosis, or treatment is required.
Instapaytient AI is not an emergency service. When a conversation indicates a potentially urgent or emergency situation, the platform may direct the patient to seek immediate professional or emergency assistance.
Instapaytient AI uses generative artificial intelligence. AI-generated responses may occasionally be incomplete, inaccurate, or inappropriate despite safeguards designed to reduce these occurrences.
Instapaytient designs, maintains, and implements safeguards intended to keep the platform operating within its intended purpose.
Instapaytient is responsible for the operation of the Instapaytient platform and does not shift responsibility for failures of its technology onto the Practice. The extent of either party's legal liability is governed by the Instapaytient Services Agreement and applicable law.
To configure and operate Instapaytient AI, Instapaytient may collect, access, crawl, index, and process publicly available information from the Practice's website and other digital properties identified or authorized by the Practice.
This information may include treatments, services, pricing, financing information, provider information, locations, policies, frequently asked questions, educational content, and other information made publicly available by the Practice.
The Practice authorizes Instapaytient to use this information to configure and operate the Practice's Instapaytient AI experience.
The Practice may also provide Instapaytient with additional materials, including treatment menus, pricing sheets, documents, PDFs, frequently asked questions, educational materials, policies, images, and other content. The Practice authorizes Instapaytient to process and use these materials for the purpose of configuring and operating its Instapaytient AI experience.
The Practice represents that it has the necessary rights and authority to provide such materials to Instapaytient for these purposes.
The Practice is responsible for the accuracy and completeness of information published on its website or otherwise provided to Instapaytient and should notify Instapaytient of material changes to information used by the platform.
Instapaytient is not responsible for inaccurate or outdated responses resulting directly from inaccurate, incomplete, outdated, or misleading information published or supplied by the Practice.
Patients may voluntarily provide information while interacting with Instapaytient AI.
Where Instapaytient's services involve the creation, receipt, maintenance, or transmission of Protected Health Information on behalf of a Practice, the parties will enter into a Business Associate Agreement when required by applicable law.
Where a Business Associate Agreement is in effect, Protected Health Information will be handled in accordance with that agreement and Instapaytient's applicable privacy and security obligations.
Patient conversations are not used by Instapaytient to train a general-purpose artificial intelligence model for the benefit of other Instapaytient customers.
Instapaytient AI is intended to assist patient engagement, not replace appropriate human oversight.
The Practice remains responsible for reviewing and responding to matters that require professional, clinical, or Practice-specific judgment.
The Practice will not intentionally configure or use Instapaytient AI to provide autonomous diagnosis, prescribe medication, make clinical treatment decisions, provide emergency medical services, or engage in unlawful activity.
The Practice will use Instapaytient AI only for lawful purposes consistent with the intended functionality of the platform.
The Practice will not intentionally use Instapaytient AI in a manner designed to circumvent safeguards, security controls, usage restrictions, or other limitations implemented by Instapaytient.
Certain Instapaytient functionality may rely on third-party technology providers, including artificial intelligence, communications, payments, financing, hosting, infrastructure, and other service providers.
Where required by applicable law or contractual obligation, Instapaytient will maintain appropriate contractual and data-protection arrangements with service providers that process protected information on Instapaytient's behalf.
Instapaytient may change or replace third-party technology providers as the platform evolves, provided that doing so does not materially reduce Instapaytient's applicable data-protection obligations to the Practice.
Artificial intelligence technology evolves rapidly. Instapaytient may modify models, safeguards, functionality, integrations, or other components of Instapaytient AI to improve performance, security, reliability, compliance, or patient experience.
These changes may include replacing or updating the artificial intelligence models or technology providers used to power portions of the platform.
Material changes affecting the Practice's contractual rights or data-protection obligations will be handled in accordance with the Instapaytient Services Agreement and applicable law.
These AI Terms supplement the Instapaytient Services Agreement.
If Instapaytient and the Practice enter into a Business Associate Agreement, that agreement will govern the parties' respective obligations concerning Protected Health Information to the extent addressed by that agreement.
If there is a conflict between these AI Terms and the Instapaytient Services Agreement regarding commercial terms, liability, or other general contractual matters, the Instapaytient Services Agreement will control.
By accepting these AI Terms, the Practice acknowledges that it understands the capabilities and limitations of generative artificial intelligence and agrees to use Instapaytient AI in accordance with these terms.
The individual accepting these AI Terms represents that they have authority to accept them on behalf of the Practice.
